Legislation for drone operations in Denmark

 When flying a drone in Denmark, you must comply with both the common European regulations and the Danish order on drones.

There are unified regulations for drone operations across the EU. This means that as a remote pilot, you must adhere to universal flight rules applicable to all remote pilots within the EU. Additionally, you can use your Danish drone certificate in all EU member states and several EEA countries. Apart from the European regulations, you must also comply with the Danish Order on drones which is additional provisions supplementing European legislation specific for Denmark.

 The EU Drone Regulation (EU) 2019/947 defines the requirements in the open category for:

  • Whether you are allowed to fly over people.
  • The required distance from uninvolved persons.
  • The maximum altitude at which you may fly your drone.
  • The maximum weight of a drone for open category operations.

If you cannot comply with the requirements in the open category, your operation falls under the specific category, where (EU) 2019/947 also sets requirements for a risk assessment (SORA), which must be conducted by the drone operator.

(EU) 2019/945 establishes the product requirements that drone manufacturers must comply with to obtain C-marking. This regulation details what a drone must be capable of if it has been certified by the manufacturer within one of the C-categories, ranging from C0 to C6.

EASA (European Union Aviation Safety Agency) has published Easy Access Rules, which summarize the legal texts of EU 2019/945 and EU 2019/947.

This compilation aims to help understand the legislation and provide methods for complying with the requirements in both the open and specific categories.

 All remote pilots in Denmark must also comply with the Danish order on drones, which supplements the European legislation. The Drone Regulation applies to all drone pilots, regardless of drone weight class.

The Regulation specifies altitude and horizontal distance requirements for operations near among other:

  • Civil and military airports
  • Embassies
  • Column-3 classified companies
  • Natura-2000 protected sites

Additionally, the Order on drones outlines requirements for flying close to or over private property and details how to obtain consent for such flights.
